1. Subject, publication and amendments to General Terms and Conditions

1.1. These General Terms and Conditions for the provision of services shall determine the conditions in accordance to which Abacuzz provides services to natural and legal persons, users of its services.

1.2. General Terms and Conditions are published on Abacuzz website.

1.3. Abacuzz has the right to make amendments to these General Terms and Conditions in accordance with changes in applicable regulations, conditions of service provision and its business policy, in which case it is obliged to notify its customers within the period stipulated by applicable regulations.

2. Offered services and prices

2.1. Abacuzz publishes its offer of services with service specifications, service prices and other commercial conditions on www.abacuzz.rs.

2.2. Abacuzz may change the prices and/or other commercial terms and informs its users thereof by publishing such information on the Abacuzz website.

3. Ordering Services

3.1. Ordering of services shall be done by submitting a request for provision of services on Abacuzz website or by contacting Abacuzz sales team.

3.2. By ordering a service and/or services the user accepts these General Terms and Conditions.

3.3. Upon receiving the request for the provision of services Abacuzz shall confirm the receipt of the latter and send a pro forma invoice for ordered services in form of an electronic document.

4. Payment

4.1. The user is obligated to make the payment for ordered services on a regular and timely manner, within the term indicated on the received pro forma invoice.

4.2. In case that the user did not receive the pro forma invoice, the user shall notify Abacuzz in writing or by calling the sales department, in order to receive the pro forma invoice.

4.3. In case a user fails to make the payment within the term specified on the pro forma invoice, the request for the provision of services becomes null and void.

4.4. Upon the receipt of payment Abacuzz shall send an invoice in electronic form and in accordance with paragraph 2.4. to the user.

5. Commencement of Service provision

5.1. Commencement of Service provision shall begin upon the receipt of payment, but no later than 24 hours from the time of the receipt of payment.

6. Suspension of Service Provision

6.1. Abacuzz may suspend the provision of services in the following cases:

a) a reasonable suspicion that a user has committed illicit or fraudulent activity or that it may cause harm to Abacuzz, user or third parties;

b) a bankruptcy or liquidation proceedings are initiated against the user

c) on users demand.

7. Information and Customer Support

7.1. A user can get all notifications in connection to Abacuzz offerings, prices of services and how to use them, on Abacuzz website www.abacuzz-media.com or the Support Ticket System. User may request support for provided services by submitting a support ticket.

7.2. Unless it is expressly provided otherwise by General Terms and Conditions, a User can submit all notifications and suggestions related to usage of service/s, as set out in Section 7.1.

8. Complaints

8.1. User may file a complaint on the quality of the services within fifteen (15) days of the relevant date of service provision.

8.2. Complaints on the quality of services shall be submitted in electronic form at: office [at] abacuzz-media [dot] com.

8.3. Abacuzz shall investigate the complaint and notify the user of the outcome within 15 (fifteen) days of the receiving of the complaint. Abacuzz shall submit the notification electronically or by other means if the user has so indicated in its request.

9. Liability

9.1. Abacuzz shall be solely responsible for the actual damage provided that the user proves that the latter arose as a direct consequence of the guilt of Abacuzz authorized persons and shall not be responsible for the loss of profits or indirect or consequential damages.

9.2. Abacuzz shall not be responsible for the operation of the network and quality of services to the extent to which Abacuzz does not manage the latter.

10. Dispute Resolution

10.1. Abacuzz and the Users shall endeavour to resolve all disputes amicably. Disputes that cannot be settled amicably shall be settled before the Commercial Court in London.

11. Entry into force

These General Terms and Conditions shall enter into force upon its publication on the Abacuzz website.
